MyHealth Matters Blog Terms and Conditions

UPMC Health Plan’s MyHealth Matters blog is designed to provide a forum of discussion on healthy lifestyles information, healthy lifestyle programs and healthcare topics. The MyHealth Matters blog provides brief descriptions of a topic or expressed points of view about a topic to help initiate discussion on topics of interest to our members. This blog is not designed as a substitute for medical advice and should in no way be taken to be the provision or practice of medical, nursing, or professional healthcare advice or services. The information provided by this blog is not intended to be used to diagnose or treat a medical condition. If you have any questions regarding a medical condition or treatment, please contact your physician. If you are experiencing a medical emergency, please dial 911 or go to an emergency room for care.
When you select a topic to comment on, you will be linked to either a UPMC Health Plan page that contains the story or the website on which that story appears. Registration
When you register to use the MyHealth Matters blog service, you must provide true, accurate, and complete registration information. Should UPMC Health Plan suspect that your information is not accurate and complete, your account may be subject to suspension or termination. To comply with the Children’s Online Privacy Protection Act, at this time, the MyHealth Matters blog service is only available to users who are at least 13 years old. If you are under 13, you may not register to use this service.
As part of the User registration process, you will be asked to provide an email address and to select a username and password. You, not UPMC Health Plan, will be responsible for all activities occurring under your username and for keeping your password secure. Please read the UPMC Health Plan’s Privacy Statement & HIPAA Forms | Terms & Conditions on www.upmchealthplan.com as to UPMC Health Plan’s handling of your protected health information – other than any health information which you willingly share in your comments on the MyHealth Matters blog with others who access and read comments. UPMC Health Plan retains the right to revoke and/or terminate any user’s registration and all privileges associated with such registration at any time, including for any violation of our terms & conditions.

UPMC Health Plan’s MyHealth Matters blog page is designed to provide a forum (not limited to our members) to share questions and experiences regarding healthy lifestyle programs. Our goal is to enhance the service we already provide on the phone, on our websites, in our live chats, and in our one-on-one relationships by giving you another place to tell us what information is important to you.

Please help us to keep your personal information private and confidential by limiting your identifiable health information on this blog. We at UPMC Health Plan take every precaution to protect your information but only you can control what you share via chat or other electronic communications. We are taking this opportunity to remind you that it is never a good idea to post comments that include your personal and identifiable information. A simple rule of thumb is that if you wouldn’t say it in a public setting (e.g. work) you should not post it to a blog page or any other social media network. In addition, you should not upload, post, email, transmit or otherwise make available any Content (e.g. comments, photos, links) that includes personal or identifying information about another person without that person’s explicit permission to do so. This includes, but is not limited to, any health or medical conditions.

Content
UPMC Health Plan may pre-screen MyHealth Matters blog Content (e.g. comments, photos, links and posts). By registering with this blog service, you understand and acknowledge that UPMC Health Plan and its designees shall have the right (but not the obligation) in their sole discretion to pre-screen, refuse, or move any Content for any reason. UPMC Health Plan and its designees shall have the right to remove any Content that violates its Terms & Conditions, or is otherwise objectionable to UPMC Health Plan. You agree that you must evaluate and bear all risks associated with the use of any Content, including reliance on the accuracy, completeness, or usefulness of such Content. In this regard, you acknowledge that you may not rely on any Content created by UPMC Health Plan or submitted to UPMC Health Plan, in all parts of this MyHealth Matters blog service.
Users of the MyHealth Matters blog service agree to NOT use this service to:
a. upload, post, email, or use any of other means of communication that make available any Content that is unlawful, harmful, threatening, abusive, harassing, tortuous, defamatory, vulgar, obscene, libelous, invasive of another’s privacy, hateful, or racially, ethnically, or otherwise objectionable
b. upload, post, e-mail, transmit, or otherwise make available any Content that contains adult content
c. upload, post, e-mail, transmit or otherwise make available any Content that exhorts others to commit illegal acts
d. harm minors in any way
e. provide medical advice
f. upload, post, e-mail, transmit or otherwise communicate any Content that you do not have a right to make available under law or that infringes any patent, trademark, trade secret, copyright, or other proprietary rights of any party
g. upload, post, e-mail, transmit or otherwise communicate any material which is unsolicited or unauthorized advertising, promotional materials, ‘junk mail,’‘spam,’‘chain letters, ’pyramid schemes,’ or any other form of solicitation.
h. upload, post, e-mail, transmit or communicate any material that contains software viruses or any other computer code, files, or programs designed to interrupt, destroy or limit the functionality of any computer software, hardware, or telecommunications equipment.
i. Repost Content that was deleted
You agree that UPMC Health Plan may, under certain circumstances and without prior notice, immediately terminate your account and access to this Service. Cause for such termination shall include, but not be limited to (a) breaches or violations of the terms & conditions (b) any postings of material in violation of copyright law (3) requests by law enforcement (d) a request by you (self-initiated account deletions) (e) or engagement in fraudulent activities. Termination of your account includes (a) removal of access to all offerings within the Services (b) deletion of your password and all related information, files and content associated with your account and (c) barring of further use of this service. Further you agree that all terminations for cause shall be made in UPMC Health Plan’s sole discretion and that UPMC Health Plan shall not be liable to you or any third party for any termination of your account, any associated email address, or access to this service.

Modifications of Terms
UPMC Health Plan shall have the right to modify the terms of this agreement at any time, which modification shall be effective immediately upon posting. Accordingly, we suggest that you check this page periodically. To make your periodic review more convenient, we will post a date at the bottom of this page.

Disclaimer of Endorsement
References in this web site to any specific commercial products, process or service by trade name, trademark, manufacturer, or otherwise, do not necessarily constitute or imply endorsement, recommendation, or favoring by UPMC Health Plan or UPMC Insurance Services Division business units.
